The part that stalls most private sales

Louisiana Mobile Home Titles: Movable, Immobilized and Everything In Between

Louisiana handles mobile homes differently from every neighboring state, and it trips up sellers and buyers alike.

Start with the default: a manufactured home is a movable, titled through the Office of Motor Vehicles like a car. A normal sale means signing over the OMV title and the buyer applying for a new one. If you have the title and it is in your name, that is the easy case.

Many Louisiana homes on owned land have been immobilized instead. Under state law the owner (and any mortgage holder) signs an act declaring the home “shall remain permanently attached” to the described land, and records it in the parish conveyance or mortgage records. From that point the home stops being a vehicle in the eyes of the state and becomes part of the real estate — an immovable. It transfers by act of sale with the land, and the old OMV title is no longer the controlling document.

The trouble comes when someone wants to move an immobilized home or buy it without the land. That takes an act of de-immobilization recorded in the same parish, a release of every mortgage on the home or the land, a certificate of mortgages, and an application back to the OMV for a brand-new certificate of title. It is doable. It is also exactly the point where most private buyers, and plenty of closing offices, give up.

Add a title still in a deceased relative’s name, a succession that was never opened, or a home bought on a handshake and never titled at all, and you can see why the sale stalls.
